Furthermore, the bidder will sign Final Inspection Agreement with the US Marshals Service to validate the bidder’s acceptance of virtual inspection and agreement that no claim(s) or withdraw from the auction shall be granted based on grounds of virtual and not in person inspection due to current unforeseen worldwide pandemic outbreak.

Department of Justice employees, and their families are PROHIBITED from bidding and purchasing any vehicle/item for sale at this auction. Also prohibited are employees, owners, and their respective family members and agents and representatives of the auctioneer and his/her company who are conducting this auction.
There is NO BUYERS PREMIUM charge on all Department of Justice sales items.
The US Marshals Service reserves the right to withdraw any vehicle or item at any time up to and during the auction, including after the auction is completed. Furthermore, the US Marshals Service has up to 2 (two) business days to approve or deny a bid for sale. If auction is cancelled and/or bid not approved by the US
Marshals Service, the bidder will be refunded his or her bid deposit in full. The successful bidder agrees to forfeit his or her bid deposit for failing to complete the sale, including failure to pay, execution of applicable documents in order to complete the sale, violation of terms of sale or failure to remove property under the terms of sale and the buyer will be subject to default proceedings. Title for property contained in a defaulted contract is vested in the US Government and will be re-offered for sale by a method determined by the US Marshals Service. Additionally, the Government assesses a 20% liquidated damage amount for such defaulted purchases. Any forfeited deposits in excess of liquidated damages, shall be deposited into the U.S. District Courts restitution account. In addition, any and all claims regarding the subject property are to be submitted to the U.S. Marshals Service.
Certain vehicles may be of foreign origin. Any bidder purchasing a “gray market” vehicle with the intention of registering it in a foreign county is cautioned that the foreign government may or may not accept a US Government Certificate of Release (Standard Form-97) to title and register a vehicle in their country. All bidders are further advised that vehicles of foreign origin (Gray Market Vehicles) will be sold for export only. The vehicles do not conform with requirements for import to the United States, including those of the Department of Transportation (DOT) and Environmental Protection Administration (EPA). The Government warrants that it will deliver all such vehicle as described in the United States for export only. It is the BUYERS responsibility to obtain any and all paperwork/forms required by Customs and Border Protection.
These provisions supersede the online sale terms and condition in which you accepted when your originally registered. By submission of your bid on this auction, you hereby agree to the terms and condition of this sale including these amended provisions.
The Successful bidder of this lot will be required to sign a Buyers Information Sheet for the US Marshals Service and this form must be executed by the buyer and signed before full payment can be processed, execute SF-97 The United States Government Certificate to Obtain Title to a Vehicle, Chain of Custody Form, and any other applicable document(s) in order to complete the sale. Sale payment in full must be received by the vendor, Cash Realty and Auctions, LLC within 48hrs of online auction closing and/or bid approval by the US Marshals Service. Payment must be in form of a certified check or money order.
Property must be removed within 5 business days from the date and time of the email notification with sale award from the US Marshals Service and/or Cash Realty and Auctions, LLC representative. If arrangements have not been made and the property remains after the 5 day allowance, storage fees will be charged and must be collected prior to release of the vehicle.
Successful bidders are cautioned that they will be responsible for loading, packing and removal of any and all property awarded to them from the exact place where the property is located, as indicated.
